GATE REMOTE POLICY

Deep Harbour Master Association (DHMA) Committee on Safety and Security has identified security issues with respect to unauthorized access into Deep Harbour (DH) by the misuse of gate access codes and remotes. In that regard, it has developed this Gate Remote Policy to monitor and limit unauthorized access to the DH gated community. Gate access keypad codes will be changed on a regular basis and addressed at a later date.

With the installation of all-new gate operator motors in February of 2018, corresponding new gate remotes were purchased for use by DHMA members. The old remotes will continue to be capable of operating the new gate operators until such time as they are determined by the Board to create a security issue. A total of up to 2 new gate remotes per DHMA address are allowed and available for DHMA owners for a deposit price at Cost (currently defined as $27/remote). All remotes must be registered electronically with DHMA management and capable of being logged into the gate security system upon every use at every entrance; all remotes are associated with a specific DHMA unit owner and address. DHMA will monitor all remote usage. All new remotes are and will remain the property of DHMA. The one-time deposits charged for use are considered a privilege extended by DHMA to an owner and may be revoked by DHMA for misuse.

Additional remotes
Additional remotes may be reserved at a deposit price of additional cost (currently defined as $100/remote) by an owner, only, with a maximum of 4 registered units per address. If a remote is reserved on behalf of a tenant, the deposit price is Additional cost. Tenants cannot reserve a new remote directly from DHMA but can request a new remote through an owner. Owners who lease their units are encouraged to include a reference to this policy in their lease, noting the replacement values of the remotes in the event a remote is lost, stolen, broken or not returned.

Lost remotes and deactivation
If an original remote is lost, replacements are available at additional cost. The “lost” remote may be deactivated by DHMA immediately upon notification to the DHMA. If DHMA identifies the reported “lost” remote in its monitoring of remote usage after the date when the remote was considered lost, it will deactivate the replacement remote(s) associated with that address.

In the event a remote is stolen, an owner can receive a new remote at Cost if the owner can present proof of the incident acceptable to the Board, such as a filed police report.

Transfer and Re-assignment
If an owner sells their unit, they may turn in all operating units to DHMA and in doing so will receive a refund for those that are fully operable and reusable, at the Boards’ discretion. New remotes do not automatically transfer to a new owner, but owners are encouraged to transfer their remotes to the new owners simply by notifying DHMA by letter detailing the remote numbers (etched on the remote), DH unit number; and names, email addresses, and phone numbers of the new owners; and a signed (by the new owners) copy of this Gate Remote Policy.

Unauthorized Use
If the Board becomes aware of a remote being used to enter DH property by a non-owner or non-resident, the Board reserves the right to deactivate that remote and demand its return.

Due Process
Dispute resolution: In the event, an owner disagrees with any decision(s) of the Board relative to this Gate Remote Policy, an owner may request a hearing before the Board in accordance with the Deep Harbour Master Association Bylaws and Enforcement Policy.

I agree to abide by this DHMA Gate Remote Policy, and understand any violation of this policy (as it may be revised from time to time) may result in revocation of gate remote use, deactivation of my remote(s), and demand by DHMA for the return my remote(s).
